Version 2026-10-06 · Effective 6 October 2026
1Introduction
1.1Acceptance
This Liability Waiver, Assumption of Risk and Participant Declaration ("Waiver") forms part of the contractual framework governing participation in an Experience booked through Shoot & Cast. By electronically accepting it, the Participant confirms that they have read, understood and voluntarily agreed to its terms, subject to applicable law.
2Nature of Shoot & Cast's Services
2.1Marketplace Role
Shoot & Cast operates as an online booking marketplace and intermediary connecting Participants with independent Operators, including fishing charters, guided fishing operators, hunting outfitters, game farms and approved travel agencies. Shoot & Cast does not own, operate, manage, supervise or control the underlying farm, lodge, vessel, vehicle, accommodation, guide, Professional Hunter, skipper or other Experience service unless expressly stated otherwise.
2.2Operator Responsibility
The relevant Operator remains responsible for planning, management, legal compliance, safety and delivery of the booked Experience and for the conduct of its personnel and suppliers.
2.3Refund Administration
Shoot & Cast may act as the Participant's point of contact for cancellation and refund administration. Financial rights relating to cancellation, recovery of funds and refunds are governed by the Terms & Conditions, Refund Policy, Booking Confirmation and applicable law. Nothing in this Waiver reduces a refund right expressly granted under those documents or mandatory law.
3Acknowledgement of Inherent Risks
- firearm use and hunting activities;
- shore, river, estuary, wading and vessel-based fishing;
- dangerous wildlife;
- dangerous sea, river or water conditions;
- changing weather and remote locations;
- vehicle or boat travel;
- uneven, slippery or unstable terrain;
- slips, falls, drowning and other accidents;
- equipment malfunction;
- illness, injury, permanent disability or death; and
- loss of or damage to personal property.
3.1Residual Risk
The Participant understands that these risks cannot be completely eliminated even where reasonable care is exercised.
4Voluntary Participation
4.1Voluntary Choice
The Participant voluntarily chooses to participate in the booked Experience and accepts the inherent risks associated with participation to the extent permitted by applicable law.
5Health Declaration
5.1Fitness
The Participant confirms that they are physically and medically capable of participating and agrees to disclose to the Operator any condition, allergy, injury or other circumstance that may reasonably affect safe participation.
6Compliance with Laws and Instructions
6.1Compliance
The Participant agrees to comply with applicable hunting, fishing, firearm, conservation, maritime and other laws, required permits, lawful Operator instructions and reasonable safety instructions. Failure to comply may result in removal from the Experience without entitlement to a refund, subject to the Refund Policy and applicable law.
6.2Fishing Licences
For fishing Experiences, the relevant Operator is responsible for ensuring that required client fishing licences or permits are in place before fishing begins. Where a permit must be issued in the Participant's own name, the Participant must provide accurate information and cooperate with the Operator.
7Wildlife and Hunting
7.1No Guarantee
Hunting success, trophy quality, trophy size and wildlife sightings cannot be guaranteed. Wildlife behaviour is unpredictable.
7.2Wounded Animals
Where a Participant wounds an animal, the applicable trophy fee or allocated animal value remains payable only to the extent provided for in the Operator's disclosed hunting policy, the Booking terms and applicable law.
8Fishing Activities
8.1No Catch Guarantee
Fishing success, catch quantity, specific fish species, weather, water and sea conditions cannot be guaranteed. No refund arises solely because fish were not caught or a particular species was not encountered, unless otherwise required by the Booking terms, Refund Policy or applicable law.
9Personal Property
9.1Responsibility
The Participant remains responsible for personal belongings including firearms, fishing equipment, cameras, electronic devices, passports, travel documents, clothing and other valuables, subject to applicable law.
10Emergency Medical Treatment
10.1Emergency Assistance
Where reasonably necessary in an emergency and the Participant is unable to provide instructions, the Participant authorises the Operator to obtain emergency medical assistance. The Participant remains responsible for medical, hospital, evacuation, rescue or related costs not recoverable from a responsible third party or insurer.
11Release and Acknowledgement
11.1Platform Role
To the fullest extent permitted by law, the Participant acknowledges that Shoot & Cast's role is limited to providing the Platform, facilitating Bookings and administering related payment and refund processes. Operational responsibility for the Experience remains with the relevant Operator.
11.2Non-Waivable Rights
Nothing in this Waiver excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited.
