Refund Policy
Version 2026-10-06 · Effective 6 October 2026
1Introduction and Role of Shoot and Cast
1.1 This Refund Policy (the "Policy") governs all requests for refunds of amounts paid to Shoot and Cast (Pty) Ltd, Reg. No. 2025/736767/07 ("Shoot and Cast") via https://shootandcast.co.za (the "Website") or otherwise in respect of any Booking.
1.2 Shoot and Cast acts solely as an intermediary which facilitates Bookings between Clients and independent third-party Vendors. Shoot and Cast does not itself render the Vendor Services, which are rendered by the relevant Vendor.
1.3 Notwithstanding its role as intermediary, Shoot and Cast shall be the Client's sole point of contact in respect of any refund, and the Client shall not be required to engage directly with any Vendor.
1.4 By making a Booking or payment, the Client acknowledges that it has read, understood and accepted this Policy, which forms part of and must be read with the Shoot and Cast Terms and Conditions.
2Definitions
In this Policy, unless the context indicates otherwise:
- "Booking" means any reservation, order or engagement of Vendor Services concluded through Shoot and Cast;
- "Booking Fee" means the facilitation or service fee charged by Shoot and Cast in respect of a Booking, as reflected on the relevant quotation or invoice;
- "Business Day" means any day other than a Saturday, Sunday or public holiday in the Republic of South Africa;
- "Client" means any person or entity that makes a Booking or payment through Shoot and Cast;
- "Service Date" means the date on which the Vendor Services are scheduled to commence;
- "Unforeseen Circumstance" means any event or circumstance beyond the reasonable control of the Client, Shoot and Cast or the Vendor, including but not limited to acts of God, severe weather, fire, flood, pandemic, epidemic, governmental or regulatory action, load-shedding or utility failure, civil unrest, strikes, or the death, serious illness or incapacity of a Vendor;
- "Vendor" means any independent third-party supplier, service provider, crew member, talent, location owner or other person engaged through Shoot and Cast to render Vendor Services; and
- "Vendor Services" means the goods and/or services to be supplied by a Vendor pursuant to a Booking.
3Payments and Disbursement to Vendors
3.1 All amounts payable in respect of a Booking shall be paid to Shoot and Cast, which shall receive such amounts on behalf of the relevant Vendor(s), save for the Booking Fee, which Shoot and Cast receives for its own account.
3.2 The Client acknowledges that Shoot and Cast may, in the ordinary course and prior to the Service Date, disburse the whole or any portion of the amounts received into the accounts of the relevant Vendor(s), including by way of deposits required to secure the Vendor Services.
3.3 Where amounts have been so disbursed, the processing of any refund shall be subject to clause 7 (Recovery of Funds from Vendors).
4Cancellation by the Client
4.1 The Client may cancel a Booking by written notice to Shoot and Cast in accordance with clause 8. Cancellation shall take effect on the date on which such notice is received by Shoot and Cast.
4.2 Subject to clauses 7 and 9, a Client who cancels a Booking shall be entitled to a refund of the amounts paid, less the Booking Fee, in accordance with the following scale:
| Notice received before the Service Date | Refund of amounts paid (excl. Booking Fee) |
|---|---|
| More than 30 days | 100% |
| 15 to 30 days | 50% |
| 7 to 14 days | 25% |
| Less than 7 days, or failure to attend | No refund |
4.3 The cancellation charges reflected in clause 4.2 constitute a reasonable cancellation penalty as contemplated in section 17 of the Consumer Protection Act, 68 of 2008, having regard to the Vendor costs committed and the limited opportunity to re-book the Vendor Services.
4.4 In lieu of cancellation, the Client may request that the Booking be rescheduled. Shoot and Cast shall use reasonable endeavours to accommodate such request, subject to Vendor availability and any additional costs charged by the Vendor, which shall be for the Client's account.
5Cancellation or Non-Performance by a Vendor or Shoot and Cast
5.1 Should a Vendor cancel a Booking, or fail to render the Vendor Services in whole or in material part, for any reason other than an Unforeseen Circumstance or a breach by the Client, Shoot and Cast shall, at the Client's election:
(a) use its best endeavours to procure a suitable replacement Vendor of comparable standing at no additional cost to the Client; or
(b) refund to the Client all amounts paid in respect of the affected Vendor Services, including the Booking Fee attributable thereto.
5.2 Should Shoot and Cast cancel a Booking for any reason other than an Unforeseen Circumstance or a breach by the Client, the Client shall be entitled to a full refund of all amounts paid, including the Booking Fee.
5.3 Where the Vendor Services have been partially rendered, any refund shall be calculated pro rata to the portion of the Vendor Services not rendered.
6Unforeseen Circumstances
6.1 Should a Booking be prevented, cancelled or materially disrupted by an Unforeseen Circumstance, Shoot and Cast shall in the first instance use reasonable endeavours to reschedule the Booking to a mutually agreed date within 90 (ninety) days of the original Service Date, without penalty to the Client.
6.2 Should rescheduling not be possible or acceptable to the Client, the Client may request a refund, whereupon Shoot and Cast shall proceed in accordance with clause 7.
6.3 Neither Shoot and Cast nor any Vendor shall be liable to the Client for any consequential loss, damage or expense arising from an Unforeseen Circumstance.
7Recovery of Funds from Vendors
7.1 Where a refund is requested or becomes due and any portion of the amounts paid by the Client has been disbursed into the account of a Vendor, Shoot and Cast shall bear sole responsibility for liaising with such Vendor and shall use its best endeavours to recover all such amounts.
7.2 In this regard, Shoot and Cast shall:
(a) notify the relevant Vendor(s) in writing of the refund request within 5 (five) Business Days of receipt thereof;
(b) keep the Client reasonably informed of the status and progress of all recovery efforts; and
(c) remit any amounts so recovered to the Client within 7 (seven) Business Days of receipt thereof, without set-off or deduction save as permitted in terms of this Policy.
7.3 Amounts held by Shoot and Cast and not yet disbursed to a Vendor shall be refunded to the Client in accordance with clause 8, without awaiting the outcome of any recovery from a Vendor.
7.4 Nothing in this Policy shall be construed as creating any contractual relationship between the Client and any Vendor in respect of the recovery of funds.
8Refund Process and Timelines
8.1 All cancellation notices and refund requests must be submitted in writing to info@shootandcast.co.za and must include the Client's full name, the Booking reference, the Service Date and the reason for the request.
8.2 Shoot and Cast shall acknowledge receipt of a refund request within 2 (two) Business Days and shall notify the Client of the outcome thereof within 7 (seven) Business Days of receipt.
8.3 Approved refunds shall be paid within 14 (fourteen) Business Days of approval or, in respect of amounts recovered from a Vendor, within the period stipulated in clause 7.2(c).
8.4 Refunds shall be made using the original payment method or by electronic funds transfer into a bank account nominated in writing by the Client. Shoot and Cast shall not be liable for any delay attributable to the Client's bank or payment provider.
8.5 All refunds shall be made in South African Rand. Any bank, card or payment gateway charges levied on the original transaction which are not reversed by the relevant provider shall be deducted from the refund amount.
9Non-Refundable Amounts
Save where otherwise provided in clause 5, the following shall not be refundable:
(a) the Booking Fee;
(b) any portion of the Vendor Services already rendered;
(c) third-party costs incurred at the Client's request which are non-refundable by their nature, including permits, licences, travel and accommodation, to the extent that such costs could not be recovered by Shoot and Cast in accordance with clause 7; and
(d) any additional costs arising from a rescheduling requested by the Client.
10Chargebacks and Disputes
10.1 The Client undertakes to first follow the refund process set out in this Policy before initiating any chargeback or payment dispute with its bank or card issuer.
10.2 Shoot and Cast reserves the right to contest any chargeback initiated in breach of clause 10.1 or in respect of an amount which is not refundable in terms of this Policy, and to recover from the Client any reasonable costs incurred in doing so.
10.3 Any dispute arising from this Policy shall first be referred to good-faith negotiation between the Client and Shoot and Cast, failing which either party may pursue the remedies available to it in law.
11Statutory Rights
11.1 Nothing in this Policy is intended to limit or exclude any right which the Client may have in terms of the Consumer Protection Act, 68 of 2008, or the Electronic Communications and Transactions Act, 25 of 2002, to the extent that either Act applies to the Client or the Booking.
11.2 Where any provision of this Policy conflicts with a non-waivable statutory right, such provision shall be read down to the extent necessary to give effect to that right, and the remainder of this Policy shall continue in full force and effect.
12Amendments, Governing Law and Contact Details
12.1 Shoot and Cast may amend this Policy from time to time by publishing the amended Policy on the Website. The version in force at the time a Booking is confirmed shall apply to that Booking.
12.2 This Policy shall be governed by and construed in accordance with the laws of the Republic of South Africa.
